  1. The following is the text of proposed federal legislation imposing
  2. possible fines, jail sentences and civil liability on purveyors of
  3. computer viruses and other harmful programs. The title of the Act is
  4. "The Computer Virus Eradication Act". It was sponsored during the
  5. 1988 session of Congress by Congressman Wally Herger, 26th District,
  6. California.

  12. To amend title 18, United States Code, to provide penalties for persons
  13. interfering with the operations of computers through the use of
  14. programs containing hidden commands that can cause harm, and for
  15. other purposes.

  17. Be it enacted by the Senate and House of Representatives of the
  18. United Sates of America in Congress assembled.
  19.  
  20.  
  21. Section 1. Short Title.
  22.  
  23. This Act may be cited as the "Computer Virus Eradication Act of
  24. 1988".
  25.  
  26. Section 2. Title 18 Amendment.
  27.  
  28.       (a) IN GENERAL.---Chapter 65 (relating to malicious mischief) of
  29. title 18, United Sates Code, is amended by adding at the end the
  30. following:
  31.  
  32. "Sec. 1368. Disseminating computer viruses and other harmful
  33. computer programs
  34.  
  35.     "(a) Whoever knowingly---
  36.  
  37.     "(1) inserts into a program for a computer information or
  38. commands, knowing or having reason to believe that such information
  39. or commands will cause loss to users of a computer on which such
  40. program is run or to those who rely on information processed on such
  41. computer; and
  42.  
  43.     "(2) provides such program to others in circumstances in which
  44. those others do not know of the insertion or its effects;
  45.  
  46. or attempts to do so, shall, if any of such conduct affects interstate or
  47. foreign commerce, be fined under this title or imprisoned not more
  48. than 10 years, or both.

  50.     "(b) Whoever suffers loss by reason of a violation of subsection (a)
  51. may, in a civil action against the violator, obtain appropriate relief. In
  52. a civil action under this section, the court may award to a prevailing
  53. party a reasonable attorney's fee and other litigation expenses.".

  56.     (b) CLERICAL AMENDMENT.---The table of sections at the
  57. beginning of chapter 65 of title 18, United States Code, is amended by
  58. adding at the end the following:
  59.     "1368. Disseminating computer viruses and other harmful computer
  60. programs.".
